New FTC Complaint Filed Against Facebook

-Privacy Camera Icon-The past couple weeks have been difficult for Facebook who has come under increasing pressure for various privacy related settings. On Wednesday, the Electronic Privacy Information Center (EPIC) filed a formal FTC complaint against Facebook. The complaint requests that the FTC “investigate Facebook, enjoin its unfair and deceptive business practices, and require Facebook to protect the privacy of Facebook users.”

More specifically, EPIC is requesting the following of the FTC:

Compel Facebook to restore its previous privacy settings allowing users to choose whether to link and publicly disclose personal information, including name, current city, friends, employment information, educational information, and music, film, television, and literature preferences;

Compel Facebook to restore its previous requirement that developers retain user information for no more than 24 hours;

Compel Facebook to make its data collection practices clearer and more comprehensible and to give Facebook users meaningful control over personal information provided by Facebook to advertisers and developers;

The last time we covered a complaint filed by EPIC was back in 2007 which was a complaint filed in response to Facebook Beacon, a program which was eventually shut down. The organization has also singled out the “Instant Personalization” program, however they appear a bit confused about how the services function.

In addition to attacking Facebook’s opt-out default for the “Instant Personalization” program, as a number of Senators have done, EPIC is claiming that “social plugins violate user expectations and reveal user information without the user’s consent”.

Update
Facebook provided us with the following statement regarding the new FTC complaint: “Our new features are providing beneficial new social experiences to people around the world that are transparent, consistent with user expectations, and in full compliance with legal requirements.” Additionally the company provided us with the following background information:
“—The concept of “connections” already existed on Facebook—it was the friends someone made and the Pages he or she had become a fan of. We’re currently rolling out changes to give people the opportunity to expand this idea to more parts of their profile by opting in to Pages representing activities and interests, education and work, and hometown. Any and all connections are only made at the direction of the user.
—Our notice and comment framework provide transparency for users that is unmatched by any service on the Internet.”

  1. I think the biggest problem here is that the majority of people don't know or care what an iframe is, and how browser security works… i still haven't figured out a way to explain it so everyone understands

    Comment by Zachary Allia — May 7, 2010 @ 8:11 am

  2. There is just as large an issue with fake profiles at FB. I am being harassed by fake profiles one is even under my own name. Conversations are being hacked, I am reporting them, nothing happens. FB does not reply back with results of reports which makes one wonder is anything at all along the lines of investigating being done. To me from my experiences there is no such thing as security at FB. Parents want their kids safe, this should be a huge issue. Recently they have shut down their abuse mailbox and left us a circuitous maze of advice is really all. There is now no way to write a report that lets you explain your problem, as if they could care less.

    Comment by KAK — May 7, 2010 @ 12:00 pm

  3. Even experienced users don't know when something is in an iframe. That's actually a good reason to avoid using them. When we cannot easily explain the security context of it, it is dangerous–too dangerous, in my opinion–to throw these things before the user.

    That's notwithstanding the ever-present iframe context leaks.

    The biggest problem, Zach, is that Facebook's new features and settings default to sharing items that were already supposed to be private. In other words, Facebook started as a private place for friends to interact, and is now looking to exploit its popularity for advertising revenue. In order to do that, it needs to get a lot more user information in the hands of its partners, but it finds its original promises get in the way.

    Facebook needs to clearly communicate its challenges and its intended change in direction, so that users will have a clear choice whether to accept the new direction or go elsewhere.

  4. KAK,

    Thank you for reporting these incidents. Although I did not investigate these particular incidents personally I can assure you we take every report very seriously. In addition just because you do not receive a reply does not indicate that the detection process has not been activated. If convicted the harasser could face severe fines and even jail time. Please continue your reporting of any and all harassment you may encounter.

  5. First of all I should start off by saying I enjoy using the site, however, I have recieved threats to temporarily block the use of my profile and to also disable my account because i'm sending friend requests too fast. I do have a life and if i cant send my requests out to who I want and at my own pace then dont worry about threatening me with anymore of that nonsense because I will personally remove myself and contact the BBB as WELL as have my family and all of their friends do the same because when one of us go we all will go. take wise counsel from a very upset and serious individual change that ridiculous policy or lose a high number of your users its just that simple the only one being abused is the users who recieve threats pretaining to your FAQ policy. Have a wonderful day and give it some serious thought.

  7. How to complain about facebook's unfair actions of disabling accounts for no reason?

    Comment by Amir — May 13, 2010 @ 3:38 pm

  8. I am a solid citizen, and used of Facebook for over one year. I am a psychologist, and although I use FB primarily to connect with friends and family from out of State, I also offer comfort and reassurance by posting relevant songs on the topic of the moment, and visual arts. Since I am also a musician and artist, I found this to be a good method to comfort people in need. I have never engaged in any type of unwanted behaviors that may be considered inappropriate by any standards applied within social norms. My FB account was recently DISABLED, but I can't get a reason as to why it was disabled, and so far my attempts to get an explanation from FB via email has been futile. Their "Solution Menu" offers no methods of solving this problem. It's circular in nature, that is always leading to square zero. The same with happened with my attempts to contact Facebook Executive Board in California by telephone. Their phone menu is circular and does offer any service by telephone. I, like many others, need an explanation of how to resolve this problem. At this point I am trying to get my professional and personal material back from them, and deleted due to the lack of trust I have developed in this company regarding privacy and problem-solving.

  10. facebook needs to be regulated by someone as it seems to be a law unto itself, I had my profile blocked deleted and I have been working on that site for 2 years digging up old friends right back to when I was young and all of a sudden I went to log in and it said it was deactivated, I had loads of photos and regular contact with friends from all over the world and wallah all of a sudden facebook has little or no concern their childish attitude has on other people

  26. I got suspend from sending friend request & did nothing wrong. If people do not want to be friends then put a block that does not send them. I did this from a game app & bingo. I contacted the add & they said it was face book also I, was told if someone spam you you get suspend you need a better system in place. A two year old can figure this out. It seem facebook allows racisist comments a few other things that should be stopped. But they do nothing about that. And you can not contact them & they do not explain why. I guess it is cause we can attitude. Even my wife say you can't ask for friends for fear of being suspend. She gets friend to have them have there friends send request. I will probably end uo switching to goggle plus. Face book need too deal with ther problems instead of ignoring them thinking they will go away.

My complaint with Facebook is the apps.gambino poker,zynga,royal poker palace,glamble,upp,perfect poker poker mob.these apps make you pay for chips well when you spent 300$ and the chips don't post you go to that app and they won't respond to your emails.there is no phone numbers for then or a address to file a formal complant with BBB, attorney general and any other agency.i would like to see there. Information so people can contact them.also Facebook should require that all apps have a email,phone number and address so we can contact that app.im also sending a complaint to the FTC because there is alot of fraud going on with Facebook.reporting people does nothing.the app royal poker palace has stalked me followed me and I report an nothing happened
